Permanent Residency, or a “green card” may be obtained through several different immigration petitions. You may obtain permanent residency after one year as an asylee, or after three years in U Nonimmigrant status, for example.

Another common way of obtaining permanent residency is through family-based applications. Someone living in the 9th Circuit Court of Appeals jurisdiction and who has temporary protective status “TPS” may also be able to adjust status if they have a qualifying relative. These are just a few of the many ways in which one may obtain a green card in the United States.

Once someone has a green card, they are considered a permanent resident. Typically, one must be a permanent resident for five years before they are eligible to apply for naturalization, but some exceptions exist. When applying for a green card, the individual must demonstrate several factors of eligibility including a criminal history clear of certain crimes, and a medical exam performed by a doctor approved by USCIS. The green card application process may take just a few months but can take over one year. The process may also involve an interview at a USCIS office but again, some exceptions exist.
